For Purchases with Dr Carla Atkinson – Functional Health Practitioner & Life Coach

1. Agreement Overview

By purchasing any offer (HTMA Standalone, Ignite, Radiate), you agree to the terms outlined below. This document ensures both parties have a clear understanding of the commitments involved.

2. Nature of Services

Services provided are for educational and coaching purposes only. They are not intended to diagnose, treat, cure, or replace medical advice or prescribed treatment.

Clients are advised to consult their doctor or other qualified health professional before making changes to diet, exercise, or supplements.

3. Confidentiality

All information you share is treated as strictly confidential and will not be disclosed without your consent, except where required by law.

4. Inclusions

A. Decode Your Body

• 1x Health Review
• 1x HTMA Functional Lab Test (Trace Elements or sister lab)
• 1x Recorded Lab Review (walkthrough of your results + protocol)
• 1x Functional Bloods Analysis
• 1x 3–4 Month Mineral Balancing Protocol
• 7 days of Telegram support
• Option to add custom supplement formula

This option is not a full coaching container and does not include ongoing support. Best suited for retests, or as an add-on to other programs.

B. Align

• Align consists of four (4) separate sessions, delivered as recorded content unless otherwise stated at the time of purchase.
• Access to recorded sessions is provided for the duration specified at enrolment.
  From time to time, a live round of Align may be offered. Access to live delivery is not guaranteed unless explicitly stated on the sales or checkout page at the time of purchase.
• Purchasing Align does not entitle the participant to live sessions, live interaction, or ongoing support unless specifically included.
• Program content, format, and delivery method may be updated or refined over time to support the highest quality experience.

C. Ignite (12 Weeks)

• Fortnightly live shared integration calls – recorded for replay access. These are not 1:1 coaching sessions.
• Replays are provided for all calls. Replay access is available for the duration of the program and does not extend beyond the 12-week period.
• Access to community & broadcast space in Telegram. Telegram access includes community + broadcast channel only. 1:1 messaging support is not included in Ignite. Response times are within business hours (9am- 3pm AEST, Tuesday-Thursday) unless otherwise stated.
• 1x HTMA Functional Lab Test Trace Elements (or a sister laboratory if required). Turnaround times for results are determined by the lab and are outside our control.
• 1x Recorded Lab Review (walkthrough of your results + protocol)
• 1x personalised mineral balancing protocol is provided based on your HTMA and Health Overview. This protocol is generally 3–4 months in length.
• Advanced testing (GI-MAP) is optional and carries an additional fee. This fee is not included in the program price.
• This program provides education, coaching, and functional support. It does not diagnose, treat, or cure medical conditions.
• Program delivery, schedule, and format may be adjusted as needed to support the highest quality experience. Any changes will be communicated with reasonable notice.
• Client results depend on individual engagement, consistency, and personal health factors.

C. Radiate (24 Weeks)

• 4 recorded or live Align Sessions
• All that is included in Ignite above (4.C)
• HTMA retest (Trace Elements or sister lab). Turnaround times vary and are outside our control.
• Recorded HTMA Review (walkthrough of your retest results + protocol).
• Revised mineral balancing protocol. Adjustments/revisions are provided within the program scope only.
• 6x 1:1 coaching and support sessions. Sessions expire at the end of the 24-week period if not used. Sessions must be requested via email to [email protected], providing three preferred dates and times between 9am and 3pm AEST, Tuesday through Thursday. Requests outside these hours cannot be guaranteed, though Carla will make reasonable efforts to accommodate where possible.
• Ongoing refinement of personalised protocol.
• A private 1:1 Telegram channel is included for personalised support during the program duration, including check-ins, guidance, and questions related to your protocol, mindset, or progress. Response times are within business hours (9am- 3pm AEST, Tuesday-Thursday) unless otherwise stated.
• Advanced testing (GI-MAP and DUTCH) is available as optional add-ons at additional cost.
• Radiate provides coaching, education, and functional support. It does not replace your medical care or diagnosis.
• Program delivery, schedule, and format may be adjusted as needed to support the highest quality experience. Any changes will be communicated with reasonable notice.

5. Duration & Expiry

• Each program is valid for its stated duration from the date of enrolment.
• For services that require client initiation (including HTMA testing and analysis), activation must occur within 4 months of purchase, unless otherwise agreed in writing.
• All inclusions as per Section 4, expire at the end of the program unless otherwise stated or agreed in writing.
• Pauses or extensions are at Carla’s discretion and must be requested in writing.
• Any additional access or extensions provided will be considered a bonus, not an entitlement.

6. Client Commitment

You agree to:

• Attend scheduled sessions on time.
• Actively participate and engage in the program.
• Complete pre-work and integration steps.
• Take responsibility for your health decisions and consult your doctor as required.

7. Payment Terms

• All payments are non-refundable. This reflects the upfront nature of lab testing, personalised protocols, and reserved time.
• Any agreed payment plans are a financing option, not “pay-as-you-go.”
• You are responsible for completing all agreed payments, even if you choose to stop participating.

8. Termination

• You may discontinue the program at any time; however, no refunds will be issued.
• Outstanding balances remain due.
• Unused sessions will not roll over unless explicitly agreed with Carla.

9. Disclaimers & Liability

You acknowledge and agree:

• Carla is not a doctor and does not diagnose or prescribe.
• All services are for educational purposes only.
• You are responsible for consulting your doctor for medical concerns.
• To the fullest extent permitted by law, liability is excluded for any outcomes, side effects, or consequences from your participation.

10. Governing Law

This agreement is governed by Australian law.

11. Functional Diagnostic Nutrition Practitioner Disclaimer

11.1 Acknowledgements

You acknowledge and accept that we:
• are trained in Functional Health but we are not medically qualified;
• are not a substitute for advice from a qualified doctor;
• recommend that you consult your doctor before making any changes to your diet or exercise regime or taking any dietary supplement;
• do not warrant the accuracy of any information provided;
• are not liable for any losses you may suffer by relying on our advice;
• do not recommend any particular product;
• are not a covered entity or a business associate of a covered entity under HIPAA.

11.2 What We Do and Do Not Do

We obtain a set of laboratory test results from a Certified Laboratory and provide you with a nutritional interpretation of those test results that you can use exclusively as an educational tool for personal health purposes.

Your doctor may use the same test results to diagnose and treat disease, but we do not do this. The information we provide is not intended to, cannot, and should not be expected to be a substitute for a personal consultation with your own qualified doctor. We do not accept any liability for any failure to identify any medical condition or disease; this is not the purpose of our services.

We may provide you with information relating to products that we believe might benefit you, but such information is not to be taken as an endorsement or recommendation. Some such products may not be available without a prescription, but we do not dispense or prescribe any prescription products. The information provided is intended for educational purposes only and should not be taken as professional medical advice or used as a substitute for medical care. We are not responsible for any adverse effects or consequences that may result, either directly or indirectly, from that information.

We will make reasonable effort to protect the privacy of your medical information that is shared with us, including any medical test results. However, that information is not protected by doctor-patient confidentiality, nor is it governed by HIPAA.

11.3 Consult Your Doctor

We are not qualified medical advisors and make no claims to be so. The information we provide should not be taken to be, and is not a substitute for, personal medical advice and instruction. You should not take any action based solely on our advice.

You should consult your doctor:
• for any medical interpretation of your test results;
• on any matter relating to your health and well-being;
• before making any changes to your exercise or diet;
• before taking any nutritional, herbal, homeopathic or hormonal supplementation;
• before beginning any therapy.

11.4 Exclusion of Warranties

We will provide our services to you with reasonable care and skill. But we make no other warranty, express or implied, with respect to those services. All other warranties are excluded to the maximum extent permitted by law.

We make no warranty as to the accuracy of the laboratory test results we receive.

We make no warranty, expressed or implied, as to the quality or effectiveness of any diagnosis, apparatus, treatment or product. In no event will we be liable for any physical or mental injury, or any negative side effects, that may arise from the use of any such diagnosis, apparatus, treatment, or product.

We believe that the information we provide, including that on our web sites, brochures, flyers, and information packets, is accurate, but we cannot guarantee such accuracy. We therefore make no warranty as to the accuracy of that information, and it should not be relied upon as being correct, complete, or accurate. It is your responsibility to verify such matters independently from primary sources of information and by taking specific professional advice.

11.5 Exclusion of Liability

If you rely on, buy, or use a product or therapy, you do so at your own risk. Each person is different, and the way someone reacts to a product or therapy may be significantly different from another. We cannot predict how you may react to any particular product or therapy.

To the maximum extent permitted by law, we exclude:
• any and all liability in contract, tort (including negligence), breach of statutory duty or otherwise for any direct, indirect, special, incidental, or consequential costs, losses, claims, damages, expenses or proceedings (including but not limited to loss of profits and wasted management time) incurred or suffered by you arising directly or indirectly out of or in connection with our services, including but not limited to any loss, damage or expense arising from any defect, error, imperfection, fault, mistake or inaccuracy with the information or advice we provide;
• any and all liability for injury or loss arising out of the use of, or reliance on, the laboratory results and/or the dietary, supplement and lifestyle suggestions we may provide;
• any and all liability for injury or loss arising from any product or treatment you may choose to take;
• any and all liability for any failure to identify any medical condition or disease. You understand and agree that this is not the purpose of our services.

This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.

11.6 No Recommendation

All material and information we may provide about products and therapies is provided solely for educational purposes and for use when discussing your health with your doctor. By providing you with such material and information, we do not necessarily endorse, recommend, or promote any such product or therapy.
